Rotator Cuff Injury/Medical Bills

Last September I was shopping at Walmart. An elderly lady driving the motorized mart-cart

caught my purse strap on the cart and continued to drive away. She tore my rotator cuff

(shoulder). Walmart informed me that they were not responsible for the injuries that I

sustained on their premises. I was incapacitated for 3 months. My medical bills were $33,152.

Walmart viewed the taped video and indicated that I should find the customer that injured me.

Although the mart-cart was their property of Walmart attorneys have indicated that I don't

have a case to pursue.

Thank you for your response. I contacted a personal injury attorney immediately after this incident. They all indicated that I don't have a case because I was injured by another customer. If you know someone that would pursue my case feel free to let me know.

Hi Steven,

I did not contact an attorney from Walmart. I was instructed

to contact the claim's office at Walmart. After they saw the tape

they called me indicating that Walmart was not responsible for

personal injuries in the store by another customer. If you know of

attorney that would like to pursue my case let me know.

I contacted several personal injury attorneys. All of them indicated that I don't have a case because I was injured by another customer. I did not speak to an attorney from Walmart.

I contacted an attorney immediately after the accident. They informed me that Walmart could not be held accountable because I was injured by another customer on their premises.

While I can't agree that you have a case, I do agree that you need to speak to your own attorney about this - NOT WALMART's. Also, do it soon. The statute of limitations on personal injury is only 2 years. Since the accident was last year - talk to someone tomorrow. Most personal injury attorneys will work on a contingency basis.

First of all, why would you ask or seek an opinion of whether you have a case from the lawyers of vey people you would sue.  Of course they are going to say you don't have a case.  Call a personal injury attorney, have him see the tape(he'll it from Walmart) and then seek his opinion.  If what you have discribe is accurate, I guarantee you have a case....call an attorney now....don't wait.
